Resumen
El presente estudio investigativo tuvo como objetivo general analizar la falta de reparación integral a la víctima en los delitos de violencia de genero. Como objetivos específicos se analizaron los elementos doctrinarios de la reparación integral a la víctima, se determinaron las consecuencias que produce la violencia de género, así como también se propuso una reforma legal que permita una efectiva reparación a la víctima de acuerdo a la normativa establecida en el Código Orgánico Integral Penal. La metodología que fue utilizada se aplicó en base a un enfoque mixto, por cuanto se utilizó por una parte el enfoque cualitativo para determinar las conceptualizaciones y características de la reparación integral de la víctima, así como también las causas y consecuencias de la violencia de genero desde un punto de vista documental. También se utilizó el enfoque cuantitativo ya que se efectuaron encuestas a una cantidad importante de abogados que ejercen el derecho penal. Por último, se recomendó se hace necesario que la Asamblea Nacional en futirás modificaciones al Código Orgánico integral Penal efectué una modificación al numeral 6 del artículo 622 que le permita a la víctima poder ejecutar de manera inmediata la reparación integral.
The general objective of this investigation was to analyze the lack of comprehensive reparation to the victim in crimes of gender violence. As specific objectives, the doctrinal elements about comprehensive reparation to the victim were analyzed, the consequences produced by gender violence were determined, as well as a legal reform that allows effective reparation to the victim according to the established regulations was proposed. in the Comprehensive Organic Criminal Code. The methodology used was based on a mixed approach because, on the one hand, the qualitative approach was used to determine the conceptualizations and characteristics of the integral reparation of the victim, as well as the causes and consequences of gender-based violence from a point of view documentary film. The quantitative approach was also used since surveys were conducted with a significant number of lawyers practicing criminal law. Finally, it was recommended that the National Assembly in future modifications to the Comprehensive Organic Criminal Code make a modification to numeral 6 of Article 622 that allows the victim to immediately execute comprehensive reparation.
