Resumen
Nuestro proyecto pretende un análisis del sistema de la Aplicación de Justicia Indígena y el Código Orgánico Integral Penal ( COIP ) en la solución de conflictos, nuestra justicia indígena en la actualidad ya se encuentra fortalecida y está establecida en la Constitución, se evidencia en el Art. 171 donde nos garantiza los derechos de todos los pueblos y nacionalidades indígena, en razón por la que se expone a la sociedad su jurisdicción, su justicia indígena cosa que la jurisdicción ordinaria muchas veces no ha respetado como el caso sonado y mediático la COCHA por ende se establece la propuesta que se agregue en el Código Orgánico Integral Penal una ley en la cual se reconozca por el Estado se acoja, se respete y poder garantizar el debido proceso de la Ley de la Justicia Indígena ya que tienen su propia asamblea y son lo que decidan que sanción establecer al delito cometido por ende mi propuesta es agregar la sentencia establecida por la corte constitucional al Código Orgánico Integral Penal para que tenga referente al tema e involucrar a la Jurisdicción Ordinaria.
Our project intends an analysis of the system of the Application of Indigenous Justice and the Comprehensive Organic Penal Code (COIP) in the resolution of conflicts, our indigenous justice is currently already strengthened and established in the Constitution, it is evidenced in Article 171 where it guarantees us the rights of all indigenous peoples and nationalities, for the reason that its jurisdiction, its indigenous justice is exposed to society, something that the ordinary jurisdiction has often not respected as the sounded and media case COCHA therefore establishes the proposal that a law be added to the Comprehensive Organic Criminal Code in which the State recognizes, embraces, respects and guarantees the due process of the Indigenous Justice Law since they have their own assembly and they are what they decide which sanction to establish the crime committed therefore my proposal is to add the sentence established by the constitutional court to the Organic Code ico Integral Penal so that it has reference to the subject and involve the Ordinary Jurisdiction.
