La Posesión Efectiva de Bienes Sucesorios en el Ecuador Durante la Emergencia Sanitaria por el COVID-19

Resumen
En este trabajo de investigación, se realiza un estudio exploratorio profundo, acerca de la institución jurídica de la Posesión Efectiva intestada de bienes hereditarios, de cara a la acelerada actualización procedimental del despacho de diligencias y trámites jurídicas, a través del desarrollo y uso de las Tecnologías de la Información, que a causa de la intempestiva irrupción de la emergencia sanitaria originada por la repentina aparición del Sars-Cov-2 a nivel global, impuso la necesidad de adecuar la actividad procesal sucesoria y la trasmisión de bienes de los difuntos, por medio de la instrumentalización de los dispositivos telemáticos, haciéndose por lo tanto necesario practicar un revisión dogmática, académica y crítica, de la transición hacia una Justicia Electrónica y sus implicaciones dentro de la Seguridad Jurídica, el Debido Proceso y la Tutela Efectiva de los Derechos.
In this research work, a deep exploratory study is made, about the legal institution of the intestate Effective Possession of hereditary goods, facing the accelerated procedural update of the dispatch of legal proceedings and procedures, through the development and use of the Information Technologies, that due to the untimely irruption of the sanitary emergency originated by the sudden appearance of the Sars-Cov-2 at global level, imposed the need to adapt the procedural activity of succession and the transmission of assets of the deceased, by means of the instrumentalization of telematic devices, making it therefore necessary to practice a dogmatic, academic and critical review of the transition towards an Electronic Justice and its implications within the Legal Security, the Due Process and the Effective Protection of Rights.
