Infracciones de Tránsito: Exclusión del cónyuge de la pena natural en el Artículo 372 (COIP)

Resumen
En virtud de la introducción de la Pena Natural en el Ecuador y su relación directa con los
principios de Proporcionalidad y Oportunidad, se ha discutido considerablemente su
aplicabilidad y esencia, por solo proceder en infracciones de tránsito y por la obligatoriedad
de cumplir con las particularidades tipificadas en el artículo 372 del Código Orgánico Integral
Penal. En la presente investigación se recopila toda la información que fundamenta dicha
institución desde un punto de vista doctrinal y legal, para exponer, por una parte, su
concepción absoluta, con el fin de entenderla en cuanto a su definición, y, por otro lado, para
analizar profundamente su limitado alcance de aplicabilidad determinado en la interpretación
textual del artículo; de donde se concluye que en la norma ecuatoriana si existe una verdadera
exclusión del cónyuge de esta figura, y por consiguiente concurre un vacío legal por una
incorrecta tipificación por parte de los legisladores.
By virtue of the introduction of the Natural Punishment in Ecuador and its direct relationship with the principles of Proportionality and Opportunity, its applicability and essence has been considerably discussed, for only proceeding in traffic infractions and for the obligation to comply with the typified particularities in article 372 of the Criminal Integral Organic Code. In this research, all the information that supports this institution from a doctrinal and legal point of view is compiled, to expose, that on the one hand, its absolute conception, in order to understand it in terms of its definition, and, on the other hand, to deeply analyze its limited scope of applicability determined in the textual interpretation of the article; from which it is concluded that in the ecuadorian law there is a true exclusion of the spouse from this figure, and therefore there is a legal void due to an incorrect classification by the legislators.
