Resumen
En el presente trabajo de investigación se efectuará un análisis referente a los
“ELEMENTOS ESENCIALES DE LA CUSTODIA COMPARTIDA Y SU
INCORPORACIÓN EN LA LEGISLACIÓN ECUATORIANA”, el principal objeto de
dicho estudio consiste en determinar si es factible o no el proponer la incorporación de esta
figura jurídica dentro del ordenamiento jurídico ecuatoriano, con el fin de garantizar la
integridad del menor y su derecho al interés superior ante la separación de sus progenitores.
Esto, porque a raíz de una separación o divorcio, la persona más afectada es el hijo o hijos
dentro de la relación. En virtud de que dicha separación, como tal produce un conflicto entre
ambos padres lo cual afecta emocionalmente al infante, por lo que la incorporación de la
custodia compartida en la legislación ecuatoriana se hace indispensable. Finalmente, se
propone la reforma del artículo 118 del Código Orgánico de la Niñez y Adolescencia para la
incorporación de la misma.
In this research work, an analysis will be made regarding the "ESSENTIAL ELEMENTS OF SHARED CUSTODY AND ITS INCORPORATION IN THE ECUADORIAN LEGISLATION", the main purpose of this study is to determine whether it is feasible or not to propose the incorporation of this legal figure within the Ecuadorian legal system, in order to ensure the integrity of the child and their right to the best interest in the separation of their parents. This, because as a result of a separation or divorce, the person most affected is the child or children within the relationship. By virtue of the fact that such separation, as such, produces a conflict between both parents which affects the child emotionally, therefore the incorporation of shared custody in the Ecuadorian legislation becomes indispensable. Finally, it is proposed the reform of article 118 of the Organic Code of Childhood and Adolescence for the incorporation of the same.
