Resumen
El presente estudio de caso, tiene como objetivo principal el análisis de la factibilidad
legal, en aplicación de la medida de esterilización coactiva reversible, como una
limitación a los derechos reproductivos, en función de prevenir futuros casos del
Síndrome de Abstinencia neonatal, como una condición derivada del consumo de
drogas durante el embarazo, y que presenta serias afectaciones en el neonato, tanto
a nivel biológico como psicológico y social y cuyo enfoque está dirigido al estudio de
la posibilidad de aplicar la medida en relación a lo establecido en la normativa vigente
en el Ecuador, y del cual se ha tomado como referente casos presentados en la ciudad
de Guayaquil. Para el desarrollo del presente trabajo investigativo se ha empleado la
metodología empírica cualitativa, mediante la entrevista a profesionales con
conocimiento del tema, así como se ha llevado a cabo el análisis en derecho
comparado respecto a la legislación Española en la que se ha podido identificar la
aplicación de una medida del tipo propuesto, además de abordarse el análisis
respecto de si la misma vulnera derechos fundamentales de la mujer, para lo cual se
desarrolla y sostienen criterios frente a posibles objeciones a la medida propuesta.
This case study its main objective the analysis of legal feasibility in application of the reversible coercive sterilization measure as a limitation to reproductive rights, in order to prevent future neonatal abstinence Syndrome as a condition derived from drug use during pregnancy and that presents serious affectations in the unborn, both biologically and psychologically and socially and whase focus is aimed at studyin the measure in relation to the provisions of the regulations in force in Ecuador, and from which cases presented in the city of Guayaquil have been taken as a reference. Fort he development of the present research work, the qualitative empirical methodology rough the interview has been use to professionals with knowledge of the subject, as well as the analysis in comparative law has been carried out regarding the l Spanish legislation in which it has been posible to identify the aplication of a measure of the proposed type in addition to adrdressing the analysis of whether it violates fundamental rights of women, for which criterion are developed and maintained faced whit possible objections to the proposed measure.
