Racismo y Xenofobia con los migrantes venezolanos en el territorio ecuatoriano

Resumen
La presente investigación jurídica se ha realizado debido a la existencia de un problema
latente que el sistema jurídico ecuatoriano y la sociedad en general, han omitido. Se trata de
uno de los tipos de discriminación más normalizado; nos referimos al racismo y xenofobia;
la que afecta a los migrantes venezolanos en el territorio ecuatoriano, quienes escapando del
éxodo de su país llegan al nuestro en busca de mejorar su calidad de vida. Sin embargo, el
recibimiento no suele ser el mejor para todos, ya que han tenido que vivir algunos episodios
de racismo y xenofobia que han ido desde agresiones físicas hasta la psicológica; pero en la
actualidad y debido a la inminente globalización, ya no solo se evidencia en el “mundo físico”
a través de episodios racista y xenófobos sino también ha ido más allá; a través del “mundo
virtual” mediante la utilización del internet. Es así que las redes sociales se han vuelto el
lugar perfecto para generar discursos racistas y xenófobos a migrantes venezolanos que se
hayan en el territorio ecuatoriano; a pesar de que dichos discursos son realizados por el
internet no existe ningún tipo de sanción en el derecho positivo ecuatoriano; conllevando a
violaciones de derechos humanos y afectando su integridad física, psíquica y moral. De esta
manera, mediante la metodología de investigación mixta se ha permitido recolectar
informaciones y opiniones de distintas fuentes y aristas inmersas en esta situación logrando
proponer mecanismos jurídicos a nivel nacional e internacional para contrarrestar la
problemática investigada.
The present legal investigation has been carried out due to the existence of a latent problem that the Ecuadorian legal system and society in general have omitted. It is one of the most normalized types of discrimination; we refer to racism and xenophobia; the one that affects Venezuelan migrants in Ecuadorian territory. Those who, escaping the exodus from their country, come to our country in search of improving their quality of life. However, the reception is not usually the best for everyone, since they have had to experience some episodes of racism and xenophobia that have ranged from physical to psychological aggression; but nowadays and due to the imminent globalization, it is not only evidenced in the "physical world" through racist and xenophobic episodes but has also gone further; through the "virtual world" through the use of the Internet. This, social networks have become the perfect place to generate racist and xenophobic speeches to Venezuelan migrants who have been in Ecuadorian territory; Despite the fact that these speeches are made over the internet, there is no type of sanction in Ecuadorian positive law; leading to violations of human rights and resembling their physical, mental and moral integrity. In this way, through the mixed research methodology, it has been possible to collect information and opinions from different sources and edges immersed in this situation, proposing legal mechanisms at the national and international level to counteract the problem investigated
