Vulneración del Debido Proceso en la aplicación del Procedimiento Penal Abreviado en Ecuador

Resumen
El siguiente trabajo de titulación que se titula “Vulneración Del Debido Proceso En La
Aplicación Del Procedimiento Penal Abreviado En Ecuador” se realizó mediante una investigación
que tiene como finalidad identificar y demostrar que existen vulneraciones de derechos al momento
de aplicar el procedimiento abreviado, de esa misma manera también analizar la constitucionalidad
de las normas establecidas en el Código Orgánico Integral Penal.
Se procedió a utilizar en el tipo de estudio métodos como el cualitativo, documental, histórico,
inductivo- deductivo y descriptivo, referente a las variables el método transversal no experimental
ya que no fueron manipuladas. Así mismo con el método de recolección de datos se procedió a
realizar encuestas que nos permitieron identificar los puntos de vista de cada abogado que realizó
la encuesta referente al procedimiento abreviado la cual es muy variada. Dentro de la aplicación
del procedimiento abreviado se identificó la vulneración del derecho al debido proceso donde se
encuentran inmersos los siguientes principios:
Presunción de inocencia.
Carga de la prueba
Prohibición de no autoincriminación
Inmediación procesal
Igualdad de armas
The following degree work entitled "Infringement of Due Process in the Application of Abbreviated Criminal Procedure in Ecuador" was conducted through a research that aims to identify and demonstrate that there are violations of rights when applying the abbreviated procedure, in the same way also analyze the constitutionality of the rules set out in the Organic Code of Criminal Integral. We proceeded to use qualitative, documentary, historical, inductive-deductive and descriptive methods in the type of studies, referring to the variables the transversal non-experimental method since they were not manipulated. Likewise, with the data collection method, we proceeded to conduct surveys that allowed us to identify the points of view of each lawyer who conducted the survey regarding the abbreviated procedure, which is very varied. Within the application of the abbreviated procedure, the violation of the right to due process was identified, where the following principles are immersed: - Presumption of innocence. - Burden of proof - Prohibition against self-incrimination - Procedural immediacy - Equality of arms
