Resumen
Por medio del presente trabajo investigativo se analizará el contexto que lleva
a cabo un funcionario público en su sitio de trabajo, se examinará la normativa
jurídica que reglamenta la función pública, la cual, es utilizada para los contratos
ocasionales, nombramientos provisionales y contratos de servicios
profesionales; se revisará la ley, la doctrina y la jurisprudencia para establecer la
posible afectación de la estabilidad laboral de los trabajadores y servidores en el
sector público.
En la investigación se usará el método de investigación histórico – documental
de enfoque cualitativo el que aportará para alcanzar un análisis sistemático de la
información, a fin de identificar la realidad laboral en el sector estatal,
identificando eventuales transgresiones a la estabilidad laboral bajo la modalidad
de usar la figura de los contratos ocasionales, nombramientos provisionales y
contratos de servicios profesionales.
