Resumen
La presente investigación tiene como objetivo el Analizar jurídicamente el derecho de los jóvenes frente al “bullying escolar” de la República del Ecuador, y su integración como forma de violencia en el artículo 67 del Código Orgánico de Niñez y Adolescencia para garantizar el respeto a integridad de los menores, está basada en una metodología cualitativa, investigación documental-bibliográfica, exploratoria, método analítico sintético, inductivo deductivo, así mismo la técnica de observación y la entrevista que fue dirigida a 6 expertos sobre la temática, en donde se evidencia la ausencia del “Bullying escolar” como forma de violencia al niño, niña y adolescencia en el Art. 67 del Código Orgánico de Niñez y Adolescencia en donde debe garantizarle el respeto a integridad de los menores ya que la mayoría de las veces estos maltratos se dan en las aulas estudiantiles y de ahí es donde surge el agresor que es la persona que agrede a la víctima a la que llamaremos agredido y también podemos citar que podría existir otra persona llamada cómplice que podría ser el docente, los compañeros o a su vez el personal que labora en la institución y que no reporta este tipo de maltrato a las autoridades respectivas.
The objective of this research is to legally analyze the right of young people against "school bullying" in the Republic of Ecuador, and its integration as a form of violence in article 67 of the Organic Code of Children and Adolescents to guarantee respect for integrity. of minors, is based on a qualitative methodology, documentary-bibliographical, exploratory research, synthetic analytical method, inductive-deductive, as well as the observation technique and the interview that was directed to 6 experts on the subject, where the absence of "School bullying" as a form of violence against children and adolescents in Art. 67 of the Organic Code for Children and Adolescents, where respect for the integrity of minors must be guaranteed, since most of the time these abuses occur in the student classrooms and that is where the aggressor emerges, who is the person who attacks the victim whom we will call the attacked and we can also I would like to mention that there could be another person called an accomplice who could be the teacher, the classmates or, in turn, the staff that works in the institution and who does not report this type of abuse to the respective authorities.
