Imposibilidad discriminatoria para ejercer tutoría o curaduría según el Artículo 518 numeral 1 del Código Civil

Resumen
El presente documento tiene como objetivo general elaborar un análisis sobre la imposibilidad
discriminatoria establecida en el artículo 518 del Código Civil respecto a las personas ciegas y el ejercicio
de la tutoría o curaduría, determinando si existe vulneración de los derechos a la igualdad y no
discriminación, para ello se ha empleado el método analítico y de campo, al igual que la técnica de
investigación encuesta, la cual fue dirigida a 20 personas con discapacidad visual de la ciudad de
Guayaquil. De esta población se obtuvo como resultado que en su mayoría son quienes aportan
principalmente en su hogar, así como que ellos generalmente realizan los trámites acompañados de un
familiar de confianza. De igual forma, su descontento ante la imposibilidad de ejercer las tutorías o
curadurías los pone en una situación de exclusión, por lo cual manifestaron estar totalmente de acuerdo
con la reforma al artículo 518 del Código Civil a fin de poder ejercer este derecho con total normalidad.
Posteriormente se presenta como propuesta esta reforma, con los articulados que la respaldan, agregando
a la vez un artículo para el fiel cumplimiento de esta medida. Finalmente, se detallan puntualmente las
correspondientes conclusiones y recomendaciones del trabajo.
The general objective of this document is to prepare an analysis of the discriminatory impossibility established in article 518 of the Civil Code with respect to blind people and the exercise of tutorship or conservatorship, determining if there is a violation of the rights to equality and non-discrimination, for this, the analytical and field method has been used, as well as the survey research technique, which was directed to 20 people with visual disabilities in the city of Guayaquil. From this population, the result was that most of them are the ones who contribute mainly at home, as well as that they generally carry out the procedures accompanied by a trusted relative. Similarly, their dissatisfaction with the impossibility of exercising tutoring or curatorship puts them in a situation of exclusion, for which they stated that they fully agreed with the reform of article 518 of the Civil Code in order to be able to exercise this right with total normality. Subsequently, this reform is presented as a proposal, with the articles that support it, adding at the same time an article for the faithful fulfillment of this measure. Finally, the corresponding conclusions and recommendations of the work are detailed in detail.
