Resumen
En el presente trabajo de tesis se ha propuesto un análisis crítico del Dictamen
No. 5-21-TI/21 de la Corte Constitucional, el cual solventó una consulta sobre la
necesidad de pronunciamiento de la Asamblea Nacional para ratificar el regreso al
tristemente célebre El Centro Internacional de Arreglo de Diferencias relativas a
Inversiones (CIADI), donde sin la debida fundamentación argumentativa se avaló el
inconsulto y unilateral Decreto del Ejecutivo 122, soslayando la aplicación de
categorías dogmáticas del Derecho Procesal Constitucional como lo son los principios
de Unidad y de Eficacia Integradora, en desmedro de los preceptos constitucionales
relativos a la rigidez constitucional y que trasgreden una elemental observancia a la
principio de interpretación sistémica y teleológica del Constitución de la República del
Ecuador.
This thesis work has proposed a critical analysis of Opinion No. 5-21-TI/21 of the Constitutional Court. 5-21-TI/21 of the Constitutional Court, which solved a consultation on the need for a pronouncement of the National Assembly to ratify the return to the infamous International Center for Settlement of Investment Disputes (ICSID), where without the due argumentative foundation, the unconsulted and unilateral Decree of the Executive 122, avoiding the application of dogmatic categories of Constitutional Procedural Law such as the principles of Unity and Integrative Effectiveness, to the detriment of the constitutional precepts related to constitutional rigidity and that transgress an elementary observance of the principle of systemic and teleological interpretation of the Constitution of the Republic of Ecuador.
