Resumen
El presente trabajo de investigación tiene como objetivo, determinar la responsabilidad Estatal por la violación de los Derechos Humanos de las Personas Privadas de Libertad, mediante una investigación teórica y dogmática jurídica que permita plantear una propuesta. Resultó importante enfocar el tema desde una perspectiva cualitativa, para ello se tomó en consideración material bibliográfico, documental, doctrinario y normativo. Las Personas Privadas de Libertad son el eje de este tema, y a su vez precisar los derechos que han sido vulnerados en la crisis carcelaria, mismo que nos ha llevado a puntualizar la responsabilidad del Estado frente a este problema. El instrumento que se utilizó para la recaudación de información, fue la entrevista, misma que se realizó a estudiosos del Derecho, que coincidieron en que se debería mejorar la política pública vinculada al sistema penitenciario. A partir de la interpretación de la información se manifestó que el Estado es el único responsable de velar por los Privados de Libertad, y así mismo culpable en caso de que se vulneren sus derechos.
The main objective of this research work is to determine State responsibility for the violation of the human rights of prisoners, through a theoretical and dogmatic legal research that allows us to propose a social interest proposal. For the development of the topic, it was important to approach it from a qualitative perspective, taking into consideration bibliographic, documentary, doctrinaire and normative material. The Prisoners of Liberty is the main focus in this issue, and in turn, to clarify the rights that have been violated in a prison crisis, which has led us to point out the responsibility of the State in this problem. The instrument used for the collection of data and information was the interview, which was conducted with different legal scholars, who agreed that the public policy linked to the penitentiary system should be improved. On the basis of the interpretation of the information, it was stated that the State is solely responsible for protecting the detainees, and also guilty if their rights are violated.
