Resumen
El presente trabajo de investigación, titulado como “DERECHO A LA IDENTIDAD DE
LAS NIÑAS Y NIÑOS, INSCRIPCIÓN DE NACIMIENTO POR PARTE DE
PROGENITORES MENORES DE EDAD.”, surge de la problemática jurídica y social que
está establecido en el Reglamento de la Ley Orgánica de Gestión de Identidad y Datos
Civiles, donde nuestro objetivo general es determinar cómo con la inscripción de
nacimiento de niños y niñas cuyos padres son menores de edad, se ejerce el derecho a la
identidad; para lo cual, se aplicó una metodología con un diseño de investigación
cualitativa, misma que consiste en demostrar e identificar mediante el método teórico y
biblioFiguras, la limitación del derecho a la identidad y de la garantía del principio de
interés superior del niño en caso de los neonatos de progenitores menores de edad. Para
esto, se ha considerado de forma referencial la sentencia No.2185-19-JP y
acumulados/21, dictaminada por la Corte Constitucional del Ecuador, misma que
constituye antecedente y jurisprudencia útil para la validación respectiva de nuestra
problemática y aplicabilidad de una solución eficaz. De esta manera, la propuesta de la
investigación guarda relación con el planteamiento de un proyecto reformatorio al Código
Orgánico de la Niñez y la Adolescencia, en el que se busca incorporar un articulado que
disponga sobre la inscripción de nacimiento de un niño recién nacido cuando sus
progenitores son menores de edad, que permita proteger, garantizar y gozar plenamente
de este derecho fundamental inherente a todo ser humano desde que nace.
The present research work, entitled as "RIGHT TO IDENTITY OF CHILDREN: BIRTH REGISTRATION BY MINOR PROGENITORS”, arises from the legal and social dilemma that is established in the Regulation of the Organic Law of Identity and Civil Data Management (LOGIDC), where our general objective is: to determine how with the birth registration of children whose parents are minors, the right to identity is exercised; for which, a methodology with a qualitative research design was applied, which consists of demonstrating and identifying through the theoretical and bibliographic method, the limitation of the right to identity and the guarantee of the principle of the best interest of the child in the case of newborns of minor parents. For this, we have considered as a reference the sentence No.2185-19-JP and accumulated/21, dictated by the Constitutional Court of Ecuador, which constitutes a precedent and useful jurisprudence for the respective validation of our problem and applicability of an effective solution. Thus, the research proposal is related to the propose of a reform project to the Organic Code for Children and Adolescents, which seeks to incorporate a provision on the birth registration of a newborn child when its parents are minors, which allows to protect, guarantee and fully enjoy this fundamental right inherent in every human being from birth.
