Resumen
El presente trabajo de investigación titulado “Problemas probatorios en el delito de
Femicidio” tiene como finalidad analizar el artículo 141 del Código Orgánico Integral Penal,
al igual que las circunstancias y medios probatorios que permiten establecer dentro de un
proceso penal la autoría del delito de Femicidio, considerando a éste como un problema social
que surge de las relaciones asimétricas de poder ejercidas por el hombre sobre la mujer. Para
cumplir con este objetivo, se empleó un estudio cualitativo enfocado en determinar los
elementos primordiales de las pruebas que materializan el asesinato de una mujer por el
hecho de ser mujer o incluso, por su condición de género. Mediante una metodología
cualitativa-descriptiva, un método deductivo y la aplicación de entrevistas a jueces de
garantías penales se identificó la necesidad de analizar detalladamente las pruebas que
demuestran la materialización del Femicidio dado que, existen elementos psicológicos del
delito que solo se pueden probar mediante la aplicación de test o evaluaciones.
This research work entitled "Evidential problems in the crime of Femicide" aims to analyze article 141 of the Organic Comprehensive Criminal Code, as well as the circumstances and means of evidence that allow establishing within a criminal process the authorship of the crime of Femicide, considering this as a social problem that arises from the asymmetric power relationships exercised by men over women. To meet this objective, a qualitative study was used focused on determining the main elements of the evidence that materialize the murder of a woman for being a woman or even for her gender condition. Through a qualitative-descriptive methodology, a deductive method and the application of interviews to judges of criminal guarantees, the need to analyze in detail the evidence that demonstrates the materialization of Femicide was identified, given that there are psychological elements of the crime that can only be proven through application of tests or evaluations.
