Regulación jurídica del teletrabajo en Ecuador: necesidad de reforma al Acuerdo Ministerial nro. MDT-2020-181

Resumen
Una de las principales dudas que surgen a tres años de la implementación del Acuerdo
Ministerial Nro. MDT-2020-181 es si su normativa es suficiente para la regulación de la figura
del teletrabajo en Ecuador y la protección de los derechos de los teletrabajadores. En virtud de
ello, este trabajo tuvo por objetivo general analizar la regulación jurídica del teletrabajo en
Ecuador a través del estudio de las disposiciones en la normativa vigente, especialmente en el
Acuerdo Ministerial MDT-2020-181, de forma que se visibilicen sus avances y carencias. Se
ha aplicado una investigación de enfoque mixto, fundamentada en la investigación de tipo
documental y la aplicación de la técnica de la encuesta. Se ha concluido que dicho acuerdo
presenta deficiencias en lo relativo al derecho a la remuneración justa, el pago de horas
extraordinarias y suplementarias, el derecho a la desconexión laboral y los beneficios de la
seguridad social.
Afterward three years of the implementation of teleworking in Ecuador, one of the main inquire that arise is whether the current regulations are enough to regulate the figure and protect the teleworkers’ rights. The general objective of this work is to analyze the legal regulation of teleworking in Ecuador through the study of the current regulations, especially those that are in the Ministerial Agreement Nro. MDT-2020-181, to evidence its advantages and deficiencies. Mixed research approach has been applied, based on documentary research and the application of the survey technique. It has been concluded that said agreement presents deficiencies in relation to the right to fair remuneration, the payment of overtime and supplementary hours, the right to disconnect from work and social security benefits.
