Resumen
El presente trabajo realiza un análisis del emergente derecho al olvido en la esfera internacional y
nacional como mecanismo de protección para otros derechos como el de la imagen, el honor, el
buen nombre, la intimidad y la autodeterminación informativa frente a la desmedida exposición de
datos personales en el mundo digital del internet. El objetivo es identificar y describir el problema
que significa la falta de regulación del derecho al olvido en Ecuador y, con ello, la consecuente
vulneración de los otros derechos mencionados. La investigación realiza un enfoque cualitativo de
este nuevo tipo de derecho con resultados obtenidos mediante técnicas como las entrevistas a
profesionales en el tema, la observación y el estudio de casos. Se concluye que en internet se
mantiene información inexacta, irrelevante y/u obsoleta debido al transcurso del tiempo, la cual es
reflejada mediante la digitalización de datos personales, representando en la actualidad, cuestiones
perjudiciales para su titular, que le dificulta continuar con su proyecto de vida.
This paper analyzes the emerging right to be forgotten in the international and national sphere as a protection mechanism for other rights such as image, honor, good name, privacy and informational self-determination in the face of the excessive exposure of personal data in the digital world of the Internet. The objective is to identify and describe the problem of the lack of regulation of the right to be forgotten in Ecuador and, with it, the consequent violation of the other rights mentioned. The research makes a qualitative approach to this new type of right with results obtained through techniques such as interviews with professionals in the field, observation and case studies. It is concluded that inaccurate, irrelevant and/or obsolete information is kept on the Internet due to the passage of time, which is reflected through the digitization of personal data, currently representing harmful issues for its owner, which makes it difficult for him to continue with his life project.
