Resumen
Esta tesis se centra en la aplicación de la tenencia compartida en el interés superior del niño, utilizando la sentencia 28-15-IN/21 como referencia. Se realizó un análisis crítico de la sentencia, así como una revisión de leyes, estudios y entrevistas con expertos y padres para identificar fortalezas y debilidades en la aplicación de la tenencia compartida. Se propuso recomendaciones basadas en las mejores prácticas y recomendaciones internacionales para implementar la tenencia compartida de manera efectiva, con el objetivo final de mejorar el bienestar de los niños en casos de custodia compartida. En definitiva, esta investigación busca contribuir a una mejor comprensión y aplicación de la tenencia compartida en el interés superior del niño, mejorando así la calidad de vida de los niños en situaciones de custodia compartida.
This thesis focuses on the application of shared custody in the best interests of the child, using judgment 28-15-IN/21 as a reference. A critical analysis of the judgment was conducted, as well as a review of laws, studies and interviews with experts and parents to identify strengths and weaknesses in the implementation of shared custody. Recommendations based on best practices and international recommendations were proposed to implement shared custody effectively, with the ultimate goal of improving the welfare of children in shared custody cases. Ultimately, this research seeks to contribute to a better understanding and implementation of shared custody in the best interests of the child, thus improving the quality of life of children in shared custody situations.
