Prescripción del Procedimiento Monitorio en la Legislación Ecuatoriana: Análisis y Derecho Comparado.

Resumen
El presente trabajo de investigación pretende explicar el vacío legal que existe en la legislación
procesal ecuatoriana sobre el tiempo que se debe aplicar para la prescripción del ejercicio de la
acción monitoria. Como objetivo general, se plantea la propuesta de una alternativa de reforma al
artículo 2415 del Código Civil, a fin de que se considere el tiempo de cinco años (5) para la
prescripción del ejercicio de la acción monitoria. En este trabajo se realiza un análisis de tipo
cualitativo, desarrollado a través de una investigación documental y explicativa del fenómeno
discutido. Como conclusión, se obtiene que la falta de un plazo específico para que prescriba la
acción monitoria ha generado diversas confusiones, lo que ha llegado a afectar tanto a los
operadores de justicia, como a los Abogados en ejercicio liberal de la profesión y, de forma
general, a todos aquellos quienes se dedican al estudio del Derecho.

As a general objetive, the proposal of an alternative reform to the article 2415 of the Civil Code is proposed, in order to consider the time of five years (5) for the statute of limitations for the exercise of the monitoring action. In this work a qualitative analysis is carried out, developed through a documentary and explanatory research of the phenomenon discussed. As a conclusion, it is obtained that the lack of a specific term for the statute of limitations of the monitoring action has generated several confusions, which has come to affect both the operators of justice, as well as Lawyers in liberal practice of the profession and, in general, all those who are dedicated to the study of Law.
