Análisis de los derechos constitucionales de las personas adultas mayores frente a la discrimación laboral.

Resumen
La discriminación hacia los adultos mayores, de manera especial en el ámbito laboral por
razones de edad, se ha convertido en uno de los principales problemas que afrontan estas
personas, generando afectaciones psicológicas que se convierten en situaciones que conllevan un
deterioro en la calidad de vida. El presente trabajo de investigación realiza un análisis jurídico
que, junto a un trabajo de campo, permite demostrar la existencia de discriminación laboral por
cuestiones de edad que sufren los adultos mayores en el sector público ecuatoriano, afectando la
calidad de vida de estas personas.
La información obtenida en este trabajo parte de métodos cualitativos y cuantitativos
como encuestas y entrevistas, misma que permitió constatar cada uno de los objetivos propuestos
en esta investigación. Esto generó una propuesta reformatoria al artículo 81, inciso 6 de la Ley
Orgánica de Servicio Público, considerado como atentatoria contra los derechos laborales del
adulto mayor en el servicio público ecuatoriano. Además, luego de un análisis documental, es
notoria la falta de políticas encaminadas a la protección y cuidado del adulto mayor en el país,
por lo que es deber del Estado trabajar en acciones que garanticen aquellos derechos que se ven
violentados en estos grupos considerados como vulnerables.
Discrimination against the elderly, especially in the workplace for reasons of age, has become one of the main problems faced by these people, generating psychological affectations that become situations that lead to a deterioration in the quality of life. The present research work carries out a legal analysis, which together with field work, allows us to demonstrate the existence of labor discrimination due to age issues suffered by older adults in the Ecuadorian public sector, affecting the quality of life of these people. The information obtained in this work is based on qualitative and quantitative methods such as surveys and interviews, which allowed verifying each of the objectives proposed in this research. This generated a reform proposal to article 81, paragraph 6 of the Organic Law of Public Service, considered as an attack against the labor rights of the elderly in the Ecuadorian public service. In addition, after a documentary analysis, the lack of policies aimed at the protection and care of the elderly in the country is notorious, so it is the duty of the State to work on actions that guarantee those rights that are violated in these groups considered as vulnerable.
