Estado de Derecho y Constitucionalidad vs. Abuso de Estados de Excepción y Emergencia: Perspectiva Constitucional.

Resumen
El presente trabajo de titulación lo hemos centrado en los Estados de excepción y cómo su
abuso afecta al cumplimiento del Estado de derecho que nuestra constitución desde el año
2008 promulga. El objetivo general de este trabajo es proponer un Reglamento a la Ley
Orgánica de Garantías Jurisdiccionales y Control Constitucional, que redefine el control
constitucional de los Estados de excepción. Como metodología utilizamos el método
cualitativo, mediante entrevistas a personas calificadas y con larga trayectoria en el área del
Derecho constitucional, las cuales nos brindaron información necesaria para entender la
realidad de nuestro país respecto a los estados de excepción.
We have focused this degree work on the States of exception and how their abuse affects compliance with the rule of law that our constitution enacts since 2008. The general objective of this work is to propose a Regulation to the Organic Law of Jurisdictional Guarantees and Constitutional Control, which redefines the constitutional control of the States of exception. As a methodology we used the qualitative method, through interviews with qualified people with a long history in the area of constitutional law, which provided us with the necessary information to understand the reality of our country regarding states of exception. With these results we have reached the conclusion and determination that the states of exception do not comply with the basic structure and that therefore it represents an unconstitutionality since the rule of law is not complied with.
