Resumen
El presente trabajo de investigación aborda la problemática del tráfico ilegal de órganos en
Ecuador, un delito que ha cobrado relevancia en el contexto nacional e internacional, amenazando
los derechos humanos fundamentales. En la investigación, se analiza la legislación ecuatoriana y
se compara con legislaciones internacionales, con el objetivo de evaluar la proporcionalidad de las
sanciones legales y proponer reformas legislativas que reflejen la gravedad de este delito. El
estudio revela la existencia de un ciclo vicioso alimentado por la alta demanda de órganos para
trasplantes y la limitada oferta de donaciones altruistas, que se ve agravado por la explotación de
la vulnerabilidad de ciertos grupos de población por parte de las redes delictivas. Se concluye la
necesidad de implementar soluciones integrales que no sólo se centren en medidas punitivas, sino
también en promover la donación voluntaria de órganos, proteger a los grupos más vulnerables y
fortalecer la cooperación internacional en la lucha contra este delito.
This research work addresses the problem of illicit organ trafficking in Ecuador, a crime that has gained relevance in the national and international context, threatening fundamental human rights. In the investigation, Ecuadorian legislation is analyzed and compared with international legislation, with the aim of evaluating the proportionality of legal sanctions and proposing legislative reforms that reflect the seriousness of this crime. The study reveals the existence of a vicious cycle fueled by the high demand for organs for transplants and the limited supply of altruistic donations, which is aggravated by the exploitation of the vulnerability of certain population groups by criminal networks. The need to implement comprehensive solutions that not only focus on punitive measures, but also on promoting voluntary organ donation, protecting the most vulnerable groups and strengthening international cooperation in the fight against this crime is concluded.
