La eficacia del informe pericial en los delitos informáticos

Resumen
Este trabajo evidencia que el avance de la tecnología está íntimamente relacionado con el crecimiento
exponencial del ciberdelito, conducta antijuridica sancionada en materia civil o penal, dependiendo de la
vulneración del bien jurídico tutelado. La prueba a valorarse debe ser examinada por un perito judicial
informático, la validez de este documento probatorio dentro del proceso judicial, podría afectarse por
varias razones, que van desde la cadena de custodia, metodología empleada, culminando con el objeto
del presente estudio, la incorrecta redacción o incompleta estructura documental aplicada por el perito
al redactar el informe pericial informático, provocando que el juez solicite un informe para mejor resolver
o en el peor de los casos que el ciberdelincuente quede liberado. Este trabajo centra el enfoque en la
necesidad de implementar en el Sistema Pericial Integral de la Función Judicial, el estándar internacional
español UNE 197010:2015 creado para la correcta elaboración de informes periciales informáticos
This work shows that the advancement of technology is closely related to the exponential growth regarding cybernetic crimes and unlawful conduct, which are punished in civil or criminal matters depending on the violation of the protected legal right. The evidence that will be used as a proof must be examined by an informatic judicial expert, thus the validity of this probative document within the juridical process could be affected for various reasons, that goes from the chain of custody, methodology used, to the purpose of this study. The incorrect redaction or incomplete documentary structure applied by the expert when writing the computer expert report, will lead the judge to request a report to clarify and solve the litigious process and if this resource doesn’t provide an aid to the procedure, to its nullification leading to the release of charges from the cybercriminal. This work focuses on the need to implement the Spanish international standard UNE 197010:2015, created for the correct preparation of computerized expert reports, in the Integral Expert System of the Judicial Function.
