El Derecho a la Cesantía como Garantía Laboral. Análisis de su Eficiencia en Ecuador

Resumen
Se desarrolló la investigación con el objetivo de analizar la eficacia del Seguro de Cesantía para
los afiliados del Instituto Ecuatoriano de Seguridad Social que se encuentran cesantes en
Guayaquil. El estudio tuvo lugar bajo los perímetros estipulados a partir de la delimitación del
problema de investigación previamente planteado. Fue sustentado en la revisión o investigación
bibliográfica y documental, a partir de que se tomaron como fuentes de consulta documentos
confiables para obtener la información necesaria, además de tesis de investigaciones sobre el
tema y documentos referentes a las normativas legales del tema de investigación. Esta
información luego de la revisión se complementa con un trabajo de campo, al hacer una
exploración del escenario real y lograr la información necesaria para dar salida a los objetivos
trazados. Se aplicó un cuestionario a abogados que ejercen libremente, los mismos con
especialización en la rama del Derecho Laboral y la Seguridad Social, para acceder a datos de
la realidad en materia del tema que se investiga. Luego de finalizado el estudio se puede concluir
que el Sistema de Seguro de Cesantía vigente tiene limitaciones en su funcionamiento por lo que
no es totalmente efectivo y se da paso a una propuesta para modificar esta realidad.
The objective of the recent investigation was to analyze the effectiveness of the Unemployment Insurance for the members of the Ecuadorian Institute of Social Security who are unemployed in Guayaquil. The study took place under the stipulated perimeters from the delimitation of the research problem previously raised. It was supported by the bibliographic and documentary review or research, from which reliable documents were taken as sources of consultation to obtain the necessary information, in addition to research theses on the subject and documents referring to the legal regulations of the research topic. This information after the review is complemented with a field investigation, by exploring the real scenario and obtaining the necessary data to achieve the proposed objectives. A questionnaire was applied to lawyers who practice freely, the same with specialization in the practice of Labor Law and Social Security, to access reality data on the subject under investigation. After carrying out this investigation, it can be concluded that the current Unemployment Insurance System has limitations in its operation, which is why it is not totally effective and a proposal is made to modify this reality.
