Resumen
En el presente trabajo analizaremos cuáles son las falencias del Código Civil y los mecanismos
para la Regulación de la Capacidad Jurídica de las personas con Discapacidad Mental. En el
capítulo 1 en el planteamiento del problema analizaremos cual es la problemática, así como el
enfoque general que la daremos a nuestra investigación. En el Capítulo 2 en el Marco Referencial,
Marco Teórico, Marco conceptual, Marco contextual y Marco Legal, analizaremos la normativa
vigente, así como la identificación de los vacíos normativos en el Código Civil al no contemplar la
Capacidad Jurídica de las personas con discapacidades mentales, al denominarlas absolutamente
incapaces. En el capítulo 3, se establece la metodología, las técnicas e instrumentos de
investigación que nos permitieron conocer el criterio de la comunidad jurídica a través de
entrevistas, Finalmente haremos una propuesta para una reforma ley al Código Civil en lo
pertinente al derecho a la Capacidad Jurídica de las personas con discapacidad mental.
In the present work we will analyze the shortcomings of the Civil Code and what would be the mechanisms for the Regulation of the Legal Capacity of people with Mental Disability. In Chapter 1 in the Problem Statement, we will analyze what is the problem, as well as the general approach that we will give to our research. In Chapter 2 in the Referential Framework, Theoretical Framework, Conceptual Framework, Contextual Framework, and Legal Framework, we will analyze the current regulations, as well as the identification of the normative gaps in the Civil Code by not contemplating the Legal Capacity of people with mental disabilities, by denominating them absolutely incapable. In chapter 3, we establish the methodology, techniques and research instruments that allowed us to know the criteria of the legal community through interviews. Finally, we will make a proposal for a reform of the Civil Code law regarding the right to legal capacity of people with mental disabilities.
