Resumen
El presente trabajo tiene como finalidad estudiar la figura de la familia y la causal de abandono
como causal del divorcio. La investigación siguió un enfoque cualitativo, tomando en cuenta las
técnicas documentales y bibliográficas de investigación, cuales sirvieron para contextualizar la
figura de la familia y la causal de abandono injustificado no solo en la legislación ecuatoriana sino
a nivel regional, además de profundizar en los antecedentes del mismo. Con base a esto, para lograr
alcanzar mejores resultados en la investigación, fue necesario realizar entrevistas a cinco jueces
de lo civil de la ciudad de Guayaquil los cuales de manera conjunta reaccionaron de forma positiva
a la propuesta de investigación, la cual pretende requerir que el demandante o interesado acredite
haber realizado un proceso de mediación familiar o psicoterapeutico con su cónyuge, en una de
las unidades del MIES responsables de este servicio o se adjunte la certificación de inasistencia
del cónyuge a la participación de este procedimiento, esto con la finalidad de agotar todos los
instrumentos posibles para salvar el matrimonio. Los resultados de la investigación señalan que el
gobierno no utiliza todos los recursos para tratar los conflictos conyugales por medio de la
participacion de la psicoterapia conyugal, restando importancia al incremento de las demandas por
causal de abandono y al principio del interés superior del niño.
The purpose of this paper is to study the figure of the family and the grounds for abandonment as grounds for divorce. The research followed a qualitative approach, taking into account documentary and bibliographic research techniques, which served to contextualize the figure of the family and the grounds for unjustified abandonment not only in Ecuadorian legislation but also at the regional level, in addition to delving into the background of it. Based on this, in order to achieve better results in the investigation, it was necessary to conduct interviews with five civil judges from the city of Guayaquil, who together reacted positively to the investigation proposal, which sought to require that the plaintiff or interested party accredits having carried out a family or psychotherapeutic mediation process with their spouse, in one of the MIES units responsible for this service or the certificate of non-attendance of the spouse to participate in this procedure is attached, this in order to exhaust all the possible instruments to save the marriage. The results of the investigation indicate that the government does not use all the resources to treat marital conflicts through the participation of marital psychotherapy, downplaying the increase in demands for abandonment grounds and the principle of the best interests of the child
