El enriquecimiento ilícito, la inversión de la carga probatoria y su vulneración en el principio de la presunción de inocencia en el Ecuador

Resumen
El presente trabajo de investigación sobre la vulneración del principio de inocencia en el
juzgamiento en ausencia, en el delito de enriquecimiento ilícito, y otros, se desarrolla sobre la
base humanista al analizar la forma flagrante como se vulnera uno de los principios
fundamentales en el debido proceso, como es la presunción de inocencia, cuando se juzga en
ausencia del procesado. Por ello, se inicia con un estudio serio sobre la falta de aplicación de la
inmediación y concentración en la audiencia de juzgamiento y el efecto jurídico que esto
ocasiona en el procesado. Se realiza un estudio conceptual de todos estos principios
consagrados en la Constitución de la República del Ecuador y el COIP, para determinar su
origen y sus principales características, así como también, se determina los antecedentes,
características y estructura de este delito, y se dan a conocer del porqué, se pueden sancionar en
ausencia del procesado. Así mismo, se realiza el análisis del caso práctico, en el que claramente
se evidencia la vulneración de la presunción de inocencia por la no aplicación de la
inmediación y concentración en la audiencia de juzgamiento.
This research work on the violation of the principle of innocence in the trial in absentia, in the crime of illicit enrichment, and others, is developed on the humanist basis by analyzing the flagrant way in which one of the fundamental principles is violated in the due process, such as the presumption of innocence, when judged in the absence of the accused. Therefore, it begins with a serious study on the lack of application of immediacy and concentration in the trial hearing and the legal effect that this causes on the accused. A conceptual study of all these principles enshrined in the Constitution of the Republic of Ecuador and the COIP is carried out, to determine its origin and its main characteristics, as well as, the antecedents, characteristics and structure of this crime are determined, and are given to know why, they can be sanctioned in the absence of the accused. Likewise, the analysis of the practical case is carried out, in which the violation of the presumption of innocence is clearly evidenced by the non-application of immediacy and concentration in the trial hearing.
