Importancia del mecanismo de silla vacía y consecuencias de su falta de promoción en el Gobierno Autónomo Descentralizado del Cantón Guayaquil

Resumen
El presente trabajo de investigaciòn buscò determinar la vulneraciòn del derecho a la silla vacía por parte del Gobierno Autónomo Descentralizado de Guayaquil, así como su efectos en la ciudadanía. Para ello se realizò un anàlisis documental exhaustivo de múltiples tratadistas y jurista expuesto en derecho constitucional, tambièn nos remitimos via internet a las pagìnas constitucionales de la Muy Ilustre Municipalidad de Guayaquil, asì mismo tambièn se acudiò físicamente hasta la instituciòn con el objeto de obtener la informaciòn màs fidedigna posible. Asì mismo se realizaron encuesta a tres grupos sociales de Guayaquil que solicitaron acceder al uso de la silla vacía, con el objeto de que nos den a conocer sus experiencia al participar e intentar hacerlo. Se pudo determinar que no existe una clara liitaciòn a este derecho constitucional debido a la falta de promociòn de la misma entre los gestores sociales, asì como tambièn escasa informaciòn sobre su uso desde que la ordenanza entrò en vigencia en el año 2011.Tambièn, al analizar la normativa legal pertinente, con especial atenciòn a la ordenanza, se constatò una falta de claridad en el artìculo pertinente que se regula este mecanismo, razón por la cual se propuso una reforma al Art. 26 a la ordenanza que regula el sistema de participaciòn ciudadana con el objetivo que se profundice sobre este derecho y asì eliminar cualquier limitaciòn a la misma.
The present research work sought to determine the violation of the right to an empty chair by the Decentralized Autonomous Government of Guayaquil, as well as its effects on citizens. For this, an exhaustive documentary analysis of multiple writers and jurist exposed in constitutional law was carried out, we also refer via internet to the constitutional pages of the Very Illustrious Municipality of Guayaquil, likewise we also physically went to the institution in order to obtain the most reliable information possible. Likewise, a survey was carried out on three social groups in Guayaquil that requested access to the use of the empty chair, in order for them to let us know their experience when participating and trying to do so. It was possible to determine that there is no clear litigation for this constitutional right due to the lack of promotion of it among social managers, as well as little information on its use since the ordinance entered into force in 2011.
