dc.description.abstract	La reciente declaratoria de inconstitucionalidad de los numerales 2 y 4 del Art. 106 Código de la Niñez y Adolescencia en la sentencia No. 28-15-IN/21 de la Corte Constitucional del Ecuador, pone fin al régimen de preferencia materna por oponer la Interés Superior del Niño y al Derecho a la Igualdad y No Discriminación de que vienen siendo objeto los progenitores paternos. En el presente trabajo tesis se ha realizado un estudio crítico sobre los distintos regímenes de tenencia parental, donde de manera simultánea se ha efectuado un análisis de la reciente jurisprudencia constitucional haciéndose necesario reformar la normativa en el sentido de reglamentar como debe aplicarse el régimen de tenencia de menores en las salas de familia de administración de justicia.	es_ES
dc.description.abstract	The recent declaration of unconstitutionality of numbers 2 and 4 of Art. 106 of the Childhood and Adolescence Code in sentence No. 28-15-IN/21 of the Constitutional Court of Ecuador, puts an end to the regime of maternal preference for opposing the Best Interest of the Child and the Right to Equality and Non-Discrimination to which the paternal parents have been subjected. In this thesis a critical study has been made on the different regimes of parental custody, where simultaneously an analysis of the recent constitutional jurisprudence has been made, making it necessary to reform the regulations in order to regulate how the regime of custody of minors should be applied in the family chambers of the administration of justice.	es_ES
