dc.description.abstractEl presente estudio se ubica en el campo de cultura jurídica y derecho humanos, el objetivo es evidenciar los cambios y la evolución del divorcio en nuestra legislación ecuatoriana en los últimos 10 años, e identificar las garantías de protección a favor de los niños. El marco teórico acoge los enfoques de la gestión social. Se utilizó la metodología cualitativa para tratar de conocer los hechos y procesos respecto al divorcio contencioso. Los resultados obtenidos permitieron determinar los parámetros para llevar un procedimiento sumario contemplados en el COGEP, establecer soluciones desde el marco legal para hacer efectivo el cumplimiento del principio del interés superior del niño.es_ES
dc.description.abstractThe present study is located in the field of legal culture and human rights, the objective is to show the changes and the evolution of divorce in our Ecuadorian legislation in the last 10 years, and to identify the guarantees of protection in favor of children. The theoretical framework embraces the approaches of social management. The qualitative methodology was used to try to know the facts and processes regarding the contentious divorce. The results obtained allowed to determine the parameters to carry out a summary procedure contemplated in the COGEP, to establish solutions from the legal framework to enforce compliance with the principle of the best interests of the child.es_ES
