dc.description.abstract	Este estudio del caso, es una narración de un sumariado administrativamente, que luego en la investigación penal es sobreseído, e incluso el elemento de juicio pasa a lo Contencioso y Administrativo, sin que se acepte la decisión del mismo; la investigación en cuatro capítulos; en el primer capítulo se tiene una referencia al principio non ne bis in ídem, como un bien jurídico doctrinal, del cual se han aplicado muchas consideraciones y se contextualiza su impacto jurídico y social. En el capítulo II se desarrolla el marco teórico, el bien jurídico y el doble juzgamiento; también las teorías sustantivas y casos parecidos en Argentina y Perú. En el capítulo III se explica la metodología que se ha seguido, que son las entrevistas a abogados, en el capítulo IV está la propuesta a la problemática, en la cual se establece la necesidad del análisis del bien jurídico como indicador	es_ES
