Resumen
El derecho de la mujer embarazada que se manifiesta en nuestra Constitución de la Republica del
Ecuador constituye un paradigma jurídico en cuanto no se encuentra normado en el Código
Orgánico de la Niñez y Adolescencia específicamente para los presuntos padres quienes no tienen
la oportunidad de demostrar lo contrario sino hasta practicarse una prueba de ADN para demostrar
de forma científica biológica la relación parento filial, está no puede ser posible sino hasta que el
niño naciera y posterior a un año tal como lo manifiesta el Código Orgánico de la Niñez y
Adolescencia, dentro de la presente investigación pretendemos demostrar la necesidad de resarcir
de alguna forma el daño causado por la negatividad biológica del presunto padre, dejando en claro
la afectación al daño moral, al patrimonio y psicológico son insubsanables mucho menos si este
presunto padre ya tiene familia. Podemos encontrar que de este tema no han existido muchas
investigaciones a pesar que el Código Orgánico de la Niñez y Adolescencia su última modificación
fue en 2021.
The right of pregnant woman that is manifested in our Constitution of the Republic of Ecuador constitutes a legal paradigm insofar as it is not regulated in the Organic Code of Childhood and Adolescence specifically for the alleged parents who do not have the opportunity to prove otherwise until perform a DNA test to demonstrate in a biological scientific way the parent-child relationship, this cannot be possible until the child was born and after a year as stated in the Organic Code of Childhood and Adolescence, within the present investigation We intend to demonstrate the need to compensate in some way for the damage caused by the biological negativity of the alleged father, making it clear that the impact on moral, patrimony and psychological damage is insurmountable, much less if this alleged father already has a family. We can find that there has not been much research on this topic despite the fact that the Organic Code for Children and Adolescents was last modified in 2021.
