Resumen
La Con reforma al Código Penal Ecuatoriano habría que analizar si hubo un avance o retroceso en la protección de los derechos fundamentales de la persona. Algunas críticas se le han hecho al COIP., al transformarse en un código con mayor nivel punitivo que el anterior, esto por la tipificación de nuevos delitos. Nuestro análisis estudia el cambio del legislador al tratar solo la calumnia como delito dejando la doctrina del código penal derogado que tipificaba distintos tipos de injurias. Esta reforma a la injuria calumniosa, ahora solo calumnia, deja totalmente desprotegidos a la honra y el buen nombre, ya que solo se sanciona como delito cuando una persona atribuye falsamente un delito a otra, quedando otras expresiones que desacreditan, e incluso son manifestaciones de desprecio y valoración al ser humano, que llegan a convertirse en ultrajes que van en contra de la dignidad y el buen nombre.
With the reform of the Ecuadorian Penal Code, it would be necessary to analyze whether there was an advance or step back in the protection of the fundamental rights of the person. Some criticisms have been made to the COIP., By becoming a code with higher punitive level than the previous one, this by the classification of new crimes. Our analysis studies the change of the legislator to treat only the slander as a crime leaving the doctrine of the repealed criminal code that typified different types of insults. This reform to slanderous insult, now only slander, leaves completely unprotected to honor and good name, since only punishable as a crime when a person falsely attributes one crime to another, leaving other expressions that discredit, and are even manifestations of disdain and valuation to the human being, that get to become outrages that go against the dignity and the good name.
